Linda Gibbons, serial and unrepentant clinic harasser, has had her day in the Supreme Court.
By an 8-1 margin, the justices rejected Linda Dale Gibbons’s argument that she should never have been charged under the Criminal Code for picketing too close to a Toronto abortion clinic.(Comments are closed on the Globe story.)
The high court did not wade into the emotionally and politically charged abortion debate, but instead confined itself to a single, technical, legal point: whether Ms. Gibbons should be dealt with under criminal or civil law.
Ms. Gibbons maintains she should have been dealt with under civil law for disobeying a court order, not charged criminally.
She was charged under section 127 of the Criminal Code. She argued that she should have been entitled to an exemption under that section that would have taken her case out of the criminal courts.
The justices disagreed.
The ruling means she will go to trial if the prosecution decides to pursue the case.

Linda Gibbons is daft and the antis are shamelessly using her. She needs to be gently led away and redirected. Very sad.
She should have pled "subornation of false muster" like the American kooks. It wouldn't have worked, but it would have made for some fun blog posts.

Who was the judge that was for her?
Nobody seems to be reporting who the dissenter is. I'll keep an eye out.
It's a very technical decision, so I doubt the dissenter is an undercover fetus fetishist. But it would be interesting to hear her/his reasons.
Morris J. Fish. His reasons were highly technical, having to do with an alternative remedy, in his view more in accordance with law.

IMO, this old bag is dangerous.
With advancing age & such obvious brain damage already, who knows what she could be talked into? I can totally see one of the extremists handing her a .38 and convincing her that she'd be doing God's Work
